Terms of Service

These Terms of Service ("Terms") govern your use of Seabhac.io ("Service"), operated by Seabhac.io ("we", "us", "our"), a company registered in Ireland. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Seabhac.io is an infrastructure monitoring platform that performs external checks against endpoints and services you configure, including HTTP/HTTPS, DNS, SSL/TLS, email authentication, DNSBL, SMTP, TCP/UDP, page speed, and SSH banner checks. Checks are run from distributed probe nodes on your behalf.
2. Accounts
- You must be at least 18 years old to create an account.
- You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
- You must provide accurate registration information and keep it up to date.
- You may not share accounts or use the Service on behalf of others without their authorisation.
- We reserve the right to suspend or terminate accounts that violate these Terms.
3. Acceptable Use
You agree not to use the Service to:
- Monitor endpoints or infrastructure you do not own or have explicit authorisation to monitor.
- Attempt to circumvent rate limits, authentication, or access controls.
- Interfere with or disrupt the Service or its infrastructure.
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Resell or sublicense access to the Service without prior written consent.
We reserve the right to suspend access immediately and without notice if we determine that your use poses a risk to the Service or third parties.
4. Plans and Billing
- Paid plans are billed in advance on a monthly or annual basis.
- All payments are processed by Stripe, Inc. ("Stripe"). By subscribing to a paid plan you agree to Stripe's terms of service. We do not store your payment card details.
- Prices are displayed on our pricing page and are exclusive of any applicable taxes (including VAT), which will be added where required by law.
- Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
- Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; no partial-period refunds are issued unless required by law.
- Refunds: We offer a 14-day money-back guarantee for new paid subscriptions. Requests must be submitted to legal@seabhac.io within 14 days of the initial charge.
- We reserve the right to change pricing with at least 30 days' notice to existing subscribers.
5. Free Plan
The free plan is provided as-is with no uptime or performance guarantees. We may modify or discontinue the free plan at any time with reasonable notice.
6. Service Availability
We aim to provide a reliable service but do not guarantee uninterrupted availability. Scheduled maintenance will be communicated in advance where practicable. We are not liable for losses resulting from downtime or service interruptions.
7. Data and Content
- You retain ownership of all data, URLs, and configurations you submit to the Service ("Your Content").
- You grant us a limited licence to use Your Content solely to provide the Service.
- We do not sell Your Content to third parties.
- You are responsible for ensuring that monitoring the endpoints you configure does not violate any third-party rights or applicable law.
8. Intellectual Property
All software, design, text, and other content forming part of the Service is owned by or licensed to Seabhac.io. Nothing in these Terms grants you any rights to our intellectual property other than the limited right to use the Service as described herein.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SEABHAC.IO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) €100.
Nothing in these Terms limits liability that cannot be excluded under Irish or EU law, including liability for death or personal injury caused by negligence, or fraud.
11. Termination
- You may delete your account at any time from your account settings.
- We may suspend or terminate your account immediately if you breach these Terms, or with 30 days' notice for any other reason.
- Upon termination, your right to use the Service ceases and we may delete your data in accordance with our Privacy Policy.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you by email or via the Service at least 14 days before material changes take effect. Continued use of the Service after changes take effect constitutes acceptance.
13. Governing Law and Disputes
These Terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ireland. If you are a consumer in the EU you may also have rights under the law of your country of residence.
